Terms and conditions
The customer (renter) of bicycles or equipment owned by Marea yacht service (renter and owner of the CARGO BIKE SARDINIA brand) who books online from the website www.cargobikesardinia.com, takes delivery of the bicycle and/or other equipment, under the terms and conditions set forth in this contract, which the renter accepts and undertakes to comply with:
DECLARES TO THIS END pursuant to and for the purposes of articles 38 and 47 of Presidential Decree 28.12.2000 n.445 and aware of the consequences, including criminal ones, envisaged in the event of false declarations under articles 75 and 76 of the same Presidential Decree
- - to have read the rental, service, and damage compensation price list and these current regulations for the provision of the bicycle rental service, which constitute, for all legal purposes, a user contract. The renter declares, pursuant to current legislation, to be aware of and accept the general contractual conditions, with particular reference to the consequences for the renter in the event of damage caused, during use of the vehicle, to himself, to the rented bicycle, to third parties, and to property, and to the exemption from liability of the Lessor, pursuant to Article 1341, paragraph 2, of the Civil Code, which are approved in writing upon signing this application form;
- - to be informed, pursuant to art. 7 of Legislative Decree 30 June 2003, n. 196 and subsequent amendments, that the personal data collected will be processed, including by computer, exclusively within the scope of the procedure for which this request is submitted.
1. To rent a bicycle, the user must present a valid ID at the agreed-upon pick-up point and formalize the contract. Rental is reserved for adults aged 18 and over.
Headquarters and Regulations
The rental and use of the bicycle presupposes the knowledge and unconditional acceptance by the user of these regulations, the rates, the opening and closing times of the company Marea yacht service with registered office in via Grazia Deledda 1, 07041 Alghero (SS) VAT number 03065580908
Use of the bicycle
- 2. Use of the bicycle presupposes the physical fitness and technical expertise of the rider. Therefore, by renting the bicycle, the rider declares to have adequate ability and appropriate skills, without reservation.
- 3. The bicycle is intended for use exclusively as a means of transportation and must be treated with care, common sense, and diligence to avoid damage to both the bicycle and its accessories. Use of the bicycle for commercial purposes is prohibited, nor may it be transferred to other parties for use without the Lessor's authorization. The Lessee may not change or modify the bicycle or its accessories without the Lessor's consent. If the Lessor changes or modifies the bicycle or its accessories without our authorization, such changes or modifications will be considered damages and a fee may be applied.
Responsibility
4. The Renter is responsible for the bicycle from delivery until its return to the Lessor. The Renter is also responsible for all damage caused to themselves, the bicycle, third parties, and any other property while using the bicycle. In the event of damage during the rental period, the Customer cannot request any form of compensation from the Lessor. By signing this document, the Customer declares to release and exonerate the Lessor from any liability and from all related actions, lawsuits, and any type of legal or arbitration proceedings. The Customer also formally undertakes to directly compensate the Lessor for any damage to the bicycles or equipment provided by the Lessor.
5. The customer must check the condition of the bicycle, including any obvious anomalies or defects, before leaving the rental location. The brakes, lights, and tire pressure must be specifically checked. If this check is inadequate or negative, the bicycle will not be considered roadworthy and may not be used. For all pedal-assisted bicycles, the battery charge level must also be checked. The Rental Company cannot guarantee that the battery charge will be sufficient for the planned trip. Any defects found must be reported to the Rental Company before leaving the rental location. The customer is responsible for any damage not reported before leaving the rental location.
6. The customer undertakes to comply with the Highway Code and any other municipal regulations while using the bicycle, and to indemnify the Lessor from any administrative violations that occur during the rental service pursuant to Legislative Decree 30 April 1992 no. 285 – New Highway Code and subsequent amendments and additions.
7. The Lessor may supervise the customer while using the bicycles and require their return if improper use is detected. The Lessor may refuse to rent to anyone suspected of being under the influence of alcohol or drugs (pursuant to Articles 186-187 of the Highway Code) or for any other reason at the Lessor's sole discretion.
8. In the event of damage to the bicycle and its equipment (excluding reasonable wear and tear and any damage to the inner tubes), however caused, the Renter will be responsible for and will pay the Company the full cost of all repairs, including the cost of replacing any damaged parts and any labor to restore the bicycle and its equipment to the condition in which they were at the start of the Rental Period. For the avoidance of doubt, the Company has the sole right to reasonably determine: (a) whether the Equipment was damaged during the Rental Period; (b) whether such damage goes beyond reasonable wear and tear; (c) the extent of such damage; and (d) the total cost of necessary repairs.
9. In the event of loss of the bicycle, regardless of cause, the Renter will be responsible for and will pay the company the full cost of replacing the bicycle. No insurance covers a stolen or lost bicycle.
10. In the event of theft, the Lessee must present the Lessor with a copy of the report filed with the competent authorities and pay an amount equal to the value of the stolen bicycle, which will be refunded if the stolen bicycle is recovered. Any damage, repairs, or parts removed from the bicycle will be deducted from this amount.
11. The bicycle must be returned, within the times communicated, to the same location where it was rented. The bicycle is considered returned only if returned directly to the Lessor; parking the e-bike outside the rental location during closing hours cannot be considered a return. Failure to return the bicycle without prior notification or in any case without exceptional circumstances will be considered a theft offense and will therefore be reported to the Judicial Authorities.
Cancellation policy
12. If the service is unavailable for the rental period due to circumstances beyond the company's control (e.g., theft, fire, earthquake, or damage from a previous rental agreement), the company will do its best to offer the renter a suitable alternative. If the company is unable to offer a suitable alternative, the renter will be entitled to a full refund of all amounts paid to the company, less any costs incurred by the company for the reservation.
13. No refunds will be provided in the event of early returns, late collections, no-shows, or changes of mind.
14. If the required identification documents and/or payment/deposit are not presented at the time of collecting the Bicycle, or if the Terms and Conditions are not respected in any way, the rental cannot be carried out and the cancellation policy will apply.
15. Cancellations can only be made by contacting the company by telephone or in writing.
16. The Renter may cancel the reservation (cancellation valid for the rental only) and receive a refund under the following conditions:
- - More than 20 days notice 95% refund
- - Less than 20 days notice 70% refund
- - Less than 7 days notice No refund
If the Renter fails to present identification documents and/or payment/deposit when picking up the bicycle, or fails to comply with the terms and conditions in any way, the rental will not be carried out and the cancellation policy will apply without any refund of the payment.
Cancellations can only be made by contacting Cargo Bike Sardinia by phone or email.
For matters not specifically mentioned in these regulations, the relationship between the contracting parties is governed by the Civil Code. Italian law applies to the interpretation and application of the contractual relationship. For any dispute between the parties, the competent court is Sassari.
